MetalUnites Terms of Use
MetalUnites offers a personalized subscription service that enables its members to access entertainment content (“MU Content”) and the webshop (“MU Store”) via the Internet, on certain Internet-enabled TVs, computers and other devices.
These Terms of Use govern your use of our service.
The terms "MU Content," "MetalUnites Content," "our content," or "the content" used in these Terms of Use refer to the personalized digital content services offered by the Platform for discovering and accessing MetalUnites content, including all features and functions, recommendations and reviews, our websites, user interfaces, and all content and software related to our service. References to "you," "your," "yours," etc. in these Terms of Use refer to the member who created the MetalUnites account and whose payment method is being charged.
Our official office hours (subject to change depending on the situation) are Monday to Friday, 9:00 a.m. to 5:00 p.m.
No goods or membership cards, etc. will be shipped outside of these hours.
Since we are a small team, this may change in the event of illness.
You may also meet us at one or two events on weekends.
You can find our opening, shipping, and holiday times in the footer of the website.
1. membership (ROCKER (m), (ROCKER (q), ROCKER (y), METALHEAD, WARRIOR)
1.1 Age Verification and Registration.
To create a user account and use MetalUnites, you must be at least 16 years old.
When registering, you confirm that you are eligible to become a MU member by checking the box "I am at least 16 years old."
Violations will result in immediate deletion of the account and permanent user ban.
Membership fees paid up to that point remain with MetalUnites and are non-refundable.
MetalUnites is not liable for false statements.
To register as a METALHEAD and WARRIOR, you will need to provide your physical address, as we will send you a membership card.
1.2 Explanation of abbreviations
The abbreviations in brackets stand for:
(m) = monthly
(q) = quarterly
(y) = annually
Your MetalUnites membership will continue automatically until you cancel.
To use MetalUnites content, you will need internet access and a compatible device, and you will be required to provide one or more payment methods.
"Payment Method" means a current, valid, and accepted payment method, which you may update from time to time and which may include payment through your third-party account. Unless you cancel your membership before your billing date, you agree that the membership fee for the subsequent billing period will be charged to your payment method (see the "Cancellation" section below).
1.3 Membership subscription, membership level, membership level
We may offer several different membership plans (also called membership levels or membership tiers).
Some membership plans may have different terms and restrictions, which will be disclosed during registration or in other notifications to you.
You can view the details of your MetalUnites membership by visiting the website metalunites.de and, after logging in, entering the "Your MU Account" submenu in the top menu and clicking on the relevant pages.
The ROCKER (m) membership level is a one-time monthly subscription and is not automatically renewed.
It's a good test option if you don't yet know which membership is best for you.
It expires automatically after one month.
The ROCKER (q) and ROCKER (y) membership levels are automatically renewed after booking.
You will be notified in advance of the upcoming renewal and can cancel before the expiration date.
The METALHEAD and WARRIOR membership levels each represent a one-year membership, as you will receive a physical membership card valid for 12 months, which is relevant for some of the partner offers.
1.4. Trial periods
Membership at the ROCKER (m) level does not include a trial period.
The ROCKER (q) and ROCKER (y) membership levels each include a 3-day trial period. Your payment method will only be charged afterward unless you cancel and terminate your membership.
The METALHEAD and WARRIOR membership levels do NOT include trial periods, as they are included with the membership card.
1.5. Upgrade/Downgrade
Downgrade not possible
Due to the different content and benefits of the membership levels, a downgrade (switching to a cheaper or shorter subscription) is not possible.
However, you can cancel your current subscription at the end of the respective term and then book a different level.
Upgrade possible at any time
A change to a higher or longer (and therefore cheaper) level (upgrade) is possible at any time and takes effect immediately.
The new term begins immediately upon activation of the upgrade.
Amounts already paid for an existing subscription will be credited to a higher subscription. Members who are interested in a quarterly or annual subscription but are unsure whether the offer meets their expectations are recommended to first purchase a monthly subscription to test MetalUnites.
2. promotional offers
From time to time, we may offer special promotional offers, plans, or memberships ("Offers").
Eligibility for an Offer will be determined by MetalUnites in its sole discretion, and we reserve the right to revoke an Offer and suspend your account if we determine that you are ineligible.
3. invoicing and termination
3.1. Billing Period.
The membership fee for MetalUnites membership (ROCKER (m), (q) or (y) / METALHEAD or WARRIOR) will be debited from the payment method you specified (PayPal, Stripe, etc.), or you can pay via SEPA bank transfer using the payment service providers "Stripe" or "Mollie." For SEPA bank transfers, the payment date is the receipt of payment (usually takes about 2-3 days). The payment date is the date specified on your "Your MU Account" page. The length of the billing period depends on the subscription type you choose when registering for the service.
SEPA bank transfer is only possible in the SEPA area: Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Norway, Austria, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland and the United Kingdom (UK).
You can become a member by credit card (Visa, Mastercard, American Express, via the payment service providers STRIPE and MOLLIE) from the following countries:
Australia, Japan, Canada, Serbia, South Korea, Turkey, United States of America (USA).
PayPal payment is possible in all countries mentioned.
The “(m)” type is a monthly payment with a higher amount and can be canceled monthly.
The “(q)” type is a quarterly payment and is slightly cheaper when calculated per month.
The “(y)” type is an annual payment and is the cheapest alternative when calculated per month.
In some cases, your payment date may change. This can happen, for example, if the amount could not be charged to your payment method, if you change your subscription, or if your paid membership started on a day that does not exist in the current month. Visit the metalunites.de website and click the "Profile and Membership" link on the "Your MU Account" page to view your next payment date.
3.2. Payment Methods.
To use the exclusive MetalUnites content for a fee, you must provide at least one payment method.
You authorize us to charge any payment method associated with your account if your primary payment method is declined or is no longer available to us to pay your subscription fee. You remain responsible for any outstanding amounts. If a payment cannot be successfully processed because the payment method in question has expired, has insufficient funds, or fails for any other reason, and you do not cancel your account, your access to our content may be blocked until we have successfully charged a valid payment method. For certain payment methods, the issuer of the payment method may charge a certain fee, such as a foreign transaction fee or other payment processing fees. Local taxes may vary depending on the payment method. For more information, please contact your payment method service provider.
3.3. Updating Your Payment Methods.
You can update your payment methods by visiting the "MU Account" page. We may also update your payment methods with information we receive from payment service providers. Following each update, you authorize us to continue charging the valid payment method(s).
3.4. Termination.
You may terminate your MetalUnites membership at any time and will continue to use MetalUnites content until the end of your billing period. To cancel, please go to the "Cancellation" section of the "MU Account" page and follow the cancellation instructions. If you cancel your membership, your account will be automatically closed at the end of the current billing period. To see when your account will be closed, simply click on "Profile and Membership" on the "MU Account" page. Without prejudice to the right to terminate for cause, MetalUnites may terminate your account by providing you with 30 days' written notice. The cancellation will take effect at the end of your current billing period.
3.5. Changes to Price and Subscription Offer.
We are entitled to change the price of our membership offers from time to time at our reasonable discretion to reflect the impact of changes in the overall costs associated with our service. Examples of cost elements that affect the price of our subscription offers include production and licensing costs, costs for the technical provision and distribution of our services, customer service and other costs of sale (e.g., invoicing and payment, marketing), general administrative and other overhead costs (e.g., rent, interest and other financing costs, costs for personnel, service providers and services, IT systems, energy), and government-imposed fees, contributions, taxes, and levies. All price changes will take effect no earlier than 30 days after notification to you. You may cancel your membership at any time during the cancellation period to avoid future charges.
3.6 Fees
You acknowledge that we may charge any payment method specified in your user account (e.g., credit card or PayPal, bank account, etc.) for any additional amounts (including taxes and late fees, if applicable) associated with any content, etc., that arise in connection with bookings and purchases made by you. All fees will be billed to the payment method you provided during registration. If you wish to specify a different payment method (e.g., a different credit card), you can change it by contacting us. You may then be temporarily unable to use MetalUnites until we have verified the new payment information.
You agree that MetalUnites may use all available legal remedies to collect booking or purchase fees if our attempts to charge your designated payment method (e.g., credit card, PayPal, or bank account, etc.) fail for any reason. This includes collection and legal fees.
4. MetalUnites content
4.1 To become a MetalUnites member, you must be at least 16 years old. Minors may only use MetalUnites under the supervision of an adult.
4.2. Registration grants you ONE access to MetalUnites. You cannot access the MetalUnites content simultaneously on another device with your access. All MetalUnites content accessed is solely for your personal, non-commercial use and may not be shared with anyone outside your household, unless permitted by your subscription. During your MetalUnites membership, we grant you a limited, non-exclusive, and non-transferable right to access the MetalUnites content. Other than that, no right, title, or interest is transferred to you. You agree not to use your subscription for public performances.
4.3. You may access MetalUnites Content from any location where you have internet access. MetalUnites is not responsible for any lack of such access. Available content may vary by region and will also change from time to time.
4.4 The MetalUnites content and services, including the store, are updated regularly. Users are not entitled to new content. This is at the discretion of MetalUnites. We are also constantly testing various aspects, including our websites, our user interfaces and our advertising features.
4.5. Depending on your subscription, some MetalUnites content may be available for a limited time.
4.6. MetalUnites plans to publish an average of 12 new exclusive content items (videos) per year. However, there is no guarantee of specific release dates. Changes or delays may occur for editorial, technical, or legal reasons.
4.7. You agree not to do the following, unless explicitly permitted by us:
(i) archive, reproduce, distribute, modify, perform, publish, license, create derivative works from, offer for sale, or use any content and information available on MetalUnites or that you have obtained from or through MetalUnites;
(ii) circumvent, remove, alter, deactivate, downgrade, block, obscure, or prevent any copy protection or other elements of MetalUnites, including the graphical user interface, any advertising or promotional features, copyright notices, and trademarks;
(iii) use any robot, spider, web scraping, or other automated process to access the MetalUnites content;
(iv) decompile, reverse engineer, or modify any software or other products or processes accessible through MetalUnites disassemble;
(v) insert code or other products or otherwise manipulate the MetalUnites content;
(vi) use data mining, data harvesting, or other extraction methods;
(vii) upload, post, email, or otherwise send or transmit any content intended to disrupt, disable, or limit the functionality of any computer software/hardware or telecommunications equipment associated with MetalUnites. This includes any software viruses or other code, files, and programs.
If you violate these Terms of Use or use the Service in an illegal or fraudulent manner, we reserve the right to terminate or restrict your use of our services.
4.8. The display quality of MetalUnites content may vary depending on the device and depends on various factors, such as your location, available bandwidth, and/or the speed of your internet connection. The availability of HD, Ultra HD, and HDR image quality depends on your internet service and device. Not all content is available in all formats, including HD, Ultra HD, and HDR, and not all subscriptions allow the reception of content in all formats. The minimum speed for viewing content in HD video quality (defined as a resolution of at least 720p) is 3.0 Mbps per stream. However, for better image quality, a faster connection is recommended. To receive content in Full HD video quality, a connection speed of at least 5.0 Mbps (defined as a resolution of at least 1080p) is recommended. To receive content in Ultra HD video quality, a connection speed of at least 15.0 Mbps (defined as a resolution of at least 4K) is recommended. You are responsible for all charges related to internet access. Please contact your internet service provider for further information about any data usage charges. The time it takes for MetalUnites content to begin playing depends on several factors, including your location, available bandwidth at the time of playback, the selected content, and the configuration of your internet-compatible device.
5. Availability and maintenance
5.1 Availability of the service
The provider strives to keep the platform continuously available. However, temporary interruptions may occur, e.g., due to technical maintenance, security updates, or external disruptions (e.g., due to hacker attacks, force majeure).
Such interruptions will be kept as short as possible and, where possible, announced in advance. The user has no right to uninterrupted availability of the platform at all times.
Short-term or temporary outages do not entitle you to a refund or reduction of fees, provided they remain within a reasonable range.
5.2. Termination of Service
The provider reserves the right to discontinue operation of the platform in whole or in part for good cause.
Good cause shall exist in particular if continued operation becomes unreasonable or impossible for economic, legal or technical reasons (e.g. natural disasters, legal prohibitions, hacker attacks, bankruptcies, etc.).
In such a case, there is no entitlement to a (pro rata) refund of contributions already paid, provided that the discontinuation of the service is beyond the control of the provider and is not due to intentional or grossly negligent behavior.
6. Passwords and account access
Your password is for your personal use only and must be kept confidential.
If you allow others to access your account (which includes access to account history information), you agree that they are acting on your behalf and that you will be bound by any changes they may make to your account, including, without limitation, changes to your subscription.
To maintain control of your account and prevent unauthorized access, you should control the devices you use to access MetalUnites and not share your password or payment account details with anyone else. You agree to provide and maintain accurate information regarding your account, including a valid email address so we can send you account-related notices.
To protect you, MetalUnites, or our partners from identity theft or other fraudulent activity, MetalUnites reserves the right to terminate your membership or temporarily suspend your account.
7. Partner offers and responsibility
7.1. Information on Partner Offers>
We inform our members about special offers, discounts, and promotions from carefully selected partner companies ("Partner Offers"). These offers are provided by the partner companies under their own responsibility.
7.2. No separate contract concluded with us
If you use a partner offer as an authorized member, the contract is concluded exclusively between you and the respective partner company. We are not a contractual partner and do not participate in the contract processing.
7.3. Responsibility of the Partner Company
From the moment you contact the partner company or take advantage of a partner offer, the partner company is solely responsible for the fulfillment, quality, safety, and legality of the offer.
7.4. Member's own review
Before taking advantage of an offer, please check whether it meets your expectations and whether the partner company is suitable for you.
7.5. Limitation of Liability
We assume no liability for the services or products of partner companies and are not liable for damages arising from their use, unless we caused these damages intentionally or through gross negligence or if they involve damage to life, body or health.
8. Miscellaneous
8.1. Applicable Law.
These Terms of Use are governed by applicable German law. MetalUnites does not participate in alternative dispute resolution proceedings before a consumer arbitration board and is not legally obligated to do so.
8.2. Unsolicited Materials.
MetalUnites does not accept unsolicited materials or ideas for MetalUnites Content and assumes no responsibility for any similarities that may exist between content or programs in any media and materials or ideas submitted to MetalUnites.
8.3. Customer Service.
For further information about our services, content, and features, or if you need support with your account, please visit the website metalunites.de. If you cannot find solutions to your problems there, please try emailing us (support(at)metalunites.de) or contacting us via our social media channels (Facebook / Instagram / threads / Mastodon / Bluesky).
8.4. Validity.
Should any provision of these Terms of Use be found to be invalid, unlawful, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall remain unaffected.
8.5. Electronic Communications.
Account-related information (e.g., payment authorizations, invoices, changes to password or payment method, confirmation and other communications) will be sent to you exclusively in electronic form, for example, as emails to the email address you provided during registration.
